Simulator user terms for everyone flying with XLB Simulations

These User Terms are also available in Finnish. The Finnish version is the authoritative version; in the event of any discrepancy, the Finnish text governs. The User Terms are complemented by the commercial terms of the applicable customer agreement — for individual customers, the Service Terms.

Parties and scope

These User Terms apply to the use of the flight simulator service provided by XLB Simulations Oy.

The other party to the contract is the user of the simulator (hereinafter the “User”).

These terms apply to all persons who use the XLB Simulations Oy flight simulator, regardless of whether the booking was made as a private individual or through a company. By accepting these terms, the User undertakes to comply with them in all use of the simulator.

1. General

XLB Simulations provides a professional-grade flight simulator for training and experience use. The simulator is not an official training, testing or certification device.

2. Nature of the service

Use of the simulator requires care and compliance with the operating and safety instructions given. The User understands that use of the simulator may occasionally involve technical faults, system updates or service breaks, and undertakes to report any deviations they observe without delay.

3. Right of use and personal nature

The right to use the simulator is personal. A booking, right of use, keys, access tokens or codes may not be handed over to another person without XLB Simulations’ permission. The simulator may be used only during approved booking times and for the agreed purpose.

4. Self-service use

Self-service use is permitted only for users whom XLB Simulations has specifically approved as self-service users. A self-service user is fully responsible for the use of the simulator during the booking, including the technical operation of the simulator and the proper ending of the session. It is especially important to ensure that the simulator systems are shut down and the power is switched off in accordance with the instructions given when the booking ends.

5. Guided use

In guided use, the simulator is operated under the direction of XLB Simulations or an operator approved by it. In that case, the technical operation of the simulator and the ending of the session are principally the responsibility of the operator, and the User must follow the instructions given.

6. Conduct and practical rules

The simulator, the cockpit and the premises must be handled with care. No food or drink may be brought into the cockpit. As an exception, water in a closed bottle is permitted. No unnecessary force may be applied to the equipment, nor may it be used improperly. All deviations, faults or problems must be reported without delay.

7. Premises and access control

The simulator is located in premises to which access requires compliance with access-control and safety practices. Keys, codes or access tokens may not be handed over to third parties. The premises must be used only for the agreed purpose and left in proper condition.

8. Safety

The User must follow all safety instructions given and act so that their activity does not endanger themselves, other persons, the equipment or the premises. XLB Simulations reserves the right to interrupt the use of the simulator immediately if safety is compromised.

9. Operating and instructing

The User may act as an operator or instructor only when specifically approved. Operating is always voluntary and does not create an employment relationship with XLB Simulations. Any credits related to operating are determined in accordance with the applicable customer agreement.

10. Cancellations

The cancellation terms applicable to simulator bookings are determined in accordance with the customer agreement concerning the User. The User undertakes to comply with the applicable cancellation terms as part of using the simulator.

11. Damage and liability

The simulator equipment is insured by XLB Simulations. The User is liable for damage caused by intentional conduct, negligence, or breach of the operating or safety instructions. The User must report any damage without delay.

12. Limitation of liability

XLB Simulations is not liable for any indirect or consequential damage, including lost time, training opportunities or the costs arising therefrom. XLB Simulations’ liability is determined in accordance with the applicable customer agreement.

13. Restriction of the right of use

XLB Simulations may restrict or remove the User’s right of use if these terms are breached or safety is compromised.

14. Data protection

XLB Simulations processes personal data in accordance with applicable data protection legislation. The data protection policy in force is available at: https://www.xlbsimulations.com/privacy. By accepting these User Terms, the User confirms having reviewed the data protection policy and accepts the processing of personal data in accordance with it.

15. Changes to the terms

These User Terms may be updated. The User must accept the terms in force before using the simulator and again whenever the terms change.

16. Acceptance

By accepting these terms, the User confirms having read and understood the User Terms and undertakes to comply with them.
